Terms of Enrollment for the Mountaineer Microcredential Academy

  1. Program Overview

    These Terms of Enrollment constitute a binding agreement between the participant (“Learner”) and West Virginia University (“WVU”) for participation in non-credit microcredential courses delivered through the WVU Mountaineer Microacademy. These offerings are designed for professional and lifelong learners seeking to enhance applied knowledge and skills. Successful completion may result in a WVU-endorsed digital badge and/or Certificate of Completion, but no academic credit is awarded or transcripted. Completion of a microcredential course does not confer admission to, or advanced standing within, any WVU degree or certificate program.

  2. Enrollment and Course Access

    Enrollment is effective upon WVU’s confirmation of registration and receipt of applicable payment. Learners are granted access to course materials for the period specified at registration. Access credentials are personal and non-transferable. Unauthorized sharing, sale, or transfer of access credentials is prohibited and may result in immediate termination of access without refund. WVU reserves the right to modify course content, delivery format, or schedule to maintain quality, comply with policy, or address operational needs.

  3. Fees, Refunds, and Cancellations

    All fees are due at registration unless otherwise specified. Refunds are available only within the stated refund window (after the course start date or after the learner has accessed the course content). There will be a 5% fee deducted from all refunds.

    Refund requests outside the designated period will be considered only under extraordinary circumstances as determined by WVU Mountaineer Microacademy, and WVU’s decision shall be final.

    WVU may cancel or postpone a course at its discretion; in such cases, WVU will issue full refunds.

  4. Learner Conduct and Academic Integrity

    Learners are expected to uphold WVU’s academic values and are expected to adhere to the WVU Policy on Student Academic Integrity and the WVU Student Conduct Code , as adapted for continuing and professional education. Academic dishonesty, including plagiarism or identity misrepresentation, prohibited. WVU reserves the right to remove a Learner for misconduct or policy violation without refund and to revoke any badge or certificate previously issued.

    Use of generative AI tools is permitted only in accordance with course guidelines. All AI-assisted work must be properly disclosed when required. Learners must maintain professional and respectful communication in all course interactions.

  5. Accessibility and Accommodations

    WVU is committed to providing accessible and inclusive learning experiences. Online materials are designed to comply with WCAG 2.1 standards. Learners who require accommodations should contact the WVU Mountaineer Microacademy before or during the course. WVU will make reasonable efforts, consistent with applicable law, to ensure equitable participation for all Learners.

  6. Data Privacy and Intellectual Property

    WVU collects, uses, and safeguards learner information in accordance with its Privacy Notice and applicable federal and state laws, including data-protection and cybersecurity statutes. Because these offerings are non-credit, participant data are not classified as educational records under FERPA; however, WVU applies equivalent safeguards to protect confidentiality and data integrity.

    All course materials—including text, video, assessments, and other content—are the intellectual property of WVU or its microcredential partners. Learners are granted a limited, non-exclusive, non-transferable, revocable license to use course materials solely for personal, non-commercial educational purposes. Copying, redistributing, reproducing, or otherwise exploiting materials for commercial or public use is strictly prohibited.

  7. Certificates and Digital Badges

    Learners who satisfy all course requirements will receive a WVU-issued Certificate of Completion or digital badge. Certificates and badges are issued electronically and verified through the WVU Mountaineer Microacademy. Completion of a course does not imply licensure, certification, or award of academic credit unless explicitly stated. WVU reserves the right to withhold or revoke credentials in cases of misconduct, error, or non-compliance with these Terms.

  8. Technical Support and Platform Availability

    Technical support is available via mountaineermicroacademy@mail.wvu.edu during regular business hours (Monday–Friday, 8 a.m.–5 p.m. ET). WVU endeavors to maintain reliable system access but does not guarantee uninterrupted, error-free, or virus-free operation. WVU may temporarily suspend access for maintenance, upgrades, or unforeseen circumstances and will use reasonable efforts to notify learners when practicable.

  9. Limitation of Liability and Indemnification

    Participation in WVU microcredential courses is voluntary and undertaken at the Learner’s own risk. To the fullest extent permitted by law, WVU, its officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to loss of data, loss of business opportunity, or interruption of service, arising from or relating to participation in the course or use of the platform. Learners agree to indemnify and hold harmless WVU and its affiliates from any claims, damages, liabilities, costs, or expenses arising from their own actions, misuse of course materials, or violation of these Terms. Nothing in this agreement shall waive WVU’s sovereign immunity as a state institution.

  10. Dispute Resolution and Governing

    Law Any dispute arising under or relating to these Terms shall first be addressed through the administrative review process of WVU Mountaineer Microacademy. If not resolved, the dispute shall be subject to mediation consistent with the laws and policies of the State of West Virginia. These Terms and all related matters are governed by, and construed in accordance with, the laws of the State of West Virginia, without regard to conflict-of-law principles. The exclusive venue for any legal action shall be the state or federal courts located in Monongalia County, West Virginia.

  11. Export Control and International Use

    Learners accessing courses from outside the United States are responsible for compliance with all applicable export control, sanctions, and local laws. WVU makes no representation that course materials are appropriate or available for use in all jurisdictions.

  12. Amendments and Acceptance

    WVU may revise these Terms from time to time to reflect changes in law, policy, or operations. The updated Terms will be posted on the WVU Microcredential Platform and are effective immediately upon posting. Continued participation after such updates constitutes acceptance of the revised Terms. By registering for a WVU microcredential course, Learners acknowledge that they have read, understood, and agree to be bound by these Terms of Enrollment.
